Processing of personal data
The following information is designed to make you aware of the aspects regarding the processing of your personal data and your rights regarding this processing in accordance with the General Data Protection Regulation 2016/679 ("GDPR") and applicable national law.
1. General information
We, the company GOLDEN WINE DISTRIBUTION S.R.L, with registered office in Ploiesti Municipality, Strada Rudului, nr. 110, Prahova County, registered at the Trade Register under no. J29/1681/23.09.2020, with CUI RO 43084188, ("the Company"), represent the controller in accordance with the GDPR. 2. Purpose of processing and categories of data processed:
The Company processes your personal data for the following purposes:
⦁ For the purpose of supplying products / providing services in the field of non-specialised wholesale of food, beverages and tobacco products in order to fulfil the Company's legal obligations;
⦁ For the purpose of pursuing the legitimate interests of the Company;
⦁ For the following purposes, all of which relate to the Company's field of activity:
⦁ Providing information on commercial offers (e.g. newsletter, electronic messages on various channels, etc.)
⦁ Providing information on the Company's events
⦁ Providing information to assist needs related to a specific product
⦁ Participating in opinion polls on the Company's products and services
In GOLDEN WINE DISTRIBUTION S.R.L the following categories of data are processed:
• Name, Surname, address, e-mail, landline and/or mobile phone numbers.
• Your contact with us, such as a note or record of a call you have made to one of our contact centres, a Customer Relations service, a forwarded e-mail or letter or other records of a contact with us;
• Information about your account, such as payment dates due or received, subscriptions you use, account numbers or other information relating to your account or that is included in our business relationship management portal with each customer;
• Access legitimacy information - we will collect passwords, passwords and similar security information used for authentication and access to accounts and services;
• Your preferences for certain products, services and lifestyles when you tell us what they are or when we assume what they are based on how you use GOLDEN WINE DISTRIBUTION S.R.L. products and services
• Marketing preferences;

• Your browsing history. GOLDEN WINE DISTRIBUTION S.R.L collects categories of websites you have browsed from your mobile, device or PC, for example sports, music or news. However, we do not have a history of the websites you browse, this is limited to a short period of time to allow for logging in. We use this interest information to send you personalised marketing offers or to show you personalised advertisements. You can opt out of ads under the Cookies section on our website www.finestore.ro or, in the case of marketing, through the settings sections on our partner sites;
• Information we obtain from other sources, such as public or private authorities, fraud prevention agencies, and other data providers. This includes demographic data, interest data, and online browsing behaviour.
• To improve the services we offer, your conversation with our consultants may be recorded and transcribed into text format. If you agree to authorize the recording and transcription, please continue your call with our consultants. If you do not wish to do so, please end the call and contact us by the other means of communication as set out in this document (email or the chat system on www.goldenwine.ro).
• For the loyalty program consisting of offering benefits, discounts, rebates to reward customer loyalty.
• The level of service provided to you - e.g. operational issues and other events that may affect our services;
• Responses to invitations and confirmations of participation in events.
The personal data we process is primarily your identifying, transactional, financial, demographic, location or other personal data that we collect directly from you or from other sources when you become our customer, or when you use our products or services.
Sensitive personal data reveals your racial and ethnic origin, political opinions, religious and philosophical beliefs, trade union affiliation, genetic data, biometric data, health data or data relating to life or sexual orientation.
GOLDEN WINE DISTRIBUTION S.R.L does not knowingly collect sensitive personal data from you for storage.
Legal basis of the processing
The legal basis for collecting and processing your data for each of the purposes mentioned above is:
⦁ The contract for the supply or provision of services to which you are a party or your request prior to entering into a contract;
⦁ Legitimate business interests of the Company, for example, preventing fraud, maintaining the security of our services, direct marketing and improving our services. Whenever we rely on this legal basis to process your data, we assess our commercial interests to ensure that they do not override your rights. In addition, in some cases you have the right to object to such processing. Legitimate interest of the Company to enable us to exercise our statutory rights in our favour, to take legal action against any illegal or damaging activities of the Company
⦁ Compliance with a mandatory legal requirement, for example, accounting and tax requirements, which are subject to strict internal policies (such as retention periods), procedures, and your right to restrict the use of your own data, which controls the subject matter of our services to be provided;
⦁ In addition, to the extent you have agreed, your consent. The processing of personal data on the basis of your consent is an additional purpose to the processing of personal data for the performance of the contract to which you are a party and does not condition the provision/performance of the contractual services.
⦁ The processing is necessary for the performance of a task serving a public interest
We will collect your personal data when, for example:
• You purchase or use any of our products and services;
• You register for a particular product or service;
• You subscribe to newsletters, alerts or other services offered by us;
• You contact us through various channels, or request information from us about a product or service;
• Visit or browse our website or other partner websites.
• You have given permission to other companies, such as our business partners or associates, as well as third party suppliers or contractors of ours, to exchange information with us about you;

• You are the customer/beneficiary of a business we purchase/provide.
We also collect information from certain organisations where appropriate and to the extent that we have legal grounds to do so. These include fraud prevention agencies, trade directories, verification/control agencies, billing agencies and contracted service providers.

3. Categories of recipients to whom personal data collected may be disclosed:
In order to achieve the purposes set out above, we use the following categories of product and service providers/recipients:
⦁ Suppliers directly/indirectly involved in the supply of products and the provision of services in the field carried out by GOLDEN WINE DISTRIBUTION S.R.L.;
⦁ State authorities (including tax authorities);
⦁ Accountants, auditors, forensic experts, lawyers or other such external advisors to the Company or to third parties providing products and services to the Company (security service providers, IT system providers, financial consultants)
⦁ Suppliers of the Company directly/indirectly involved in the marketing and promotion process.
4. Shelf life
Your personal data will be kept by the Company for a period not exceeding the period necessary to achieve the purposes described above and/or for any other duration required by virtue of the legal obligations applicable to the Company. As a general rule, your data is kept as long as you have an account on our platform but some of it may be kept after the account has been closed for a period of 10 years in accordance with applicable tax legislation or when our legitimate interests so require.
5. Your rights
The Regulation gives individuals whose personal data is processed a number of rights. Thus, in addition to the existing rights, we also have the right to data portability and the right to data erasure. In short, your rights:

The right to withdraw at any time a consent given in order to stop a data processing that is based on your consent. Withdrawal will not affect the lawfulness of the processing based on the consent given before the withdrawal, for the performance of a contract, for the fulfilment of a legal obligation or for the purpose of pursuing our legitimate interests.
Right of access - means that you have the right to obtain confirmation from us whether or not we are processing personal data about you and, if so, you have access to that data and information on how that data is processed.
The right to data portability - this refers to the right to receive personal data in a structured, commonly used and machine-readable format by us, as well as the right to have such data transmitted directly to another controller if technically feasible.
Right to object - this concerns your right to object to the processing of personal data when the processing is necessary for the performance of a task carried out in the public interest or in the legitimate interest of the controller. Where the processing of personal data is for the purposes of direct marketing or processing carried out on the basis of express consent, you have the right to object to the processing at any time.
Right to erasure of data ("right to be forgotten") - means that you have the right to request the erasure of personal data, without undue delay, if one of the following grounds applies: they are no longer necessary for the purposes for which they were collected or processed; you withdraw your consent and there is no other legal basis for the processing; you object to the processing and there are no other compelling legitimate grounds; personal data have been unlawfully processed; personal data must be erased to comply with a legal obligation; personal data have been collected in connection with the provision of information society services.
Right to restriction of processing - can be exercised if the person disputes the accuracy of the data for a period necessary to verify the accuracy of the data; the processing is unlawful and you object to the erasure of the personal data and request restriction instead; if GOLDEN WINE DISTRIBUTION S. R.L no longer needs the personal data for processing purposes, but the data subject requests it for the establishment, exercise or defence of legal claims; if the data subject has objected to the processing for the period of time during which it is verified whether the legitimate rights of the controller prevail over those of the data subject
Right to lodge a complaint - complaints about the processing of personal data may be addressed to the National Supervisory Authority for Personal Data Processing.
The customer has at any time the unconditional possibility to send a written request/notification/complaint, even unjustified, to Golden Wine at the email office@goldenwine.ro or at the address Municipiul Ploiesti, Strada Rudului, nr. 110, Prahova County, in order to unsubscribe from the newsletter or to express their intention not to receive from Golden Wine, by any means of communication, at the contact details provided (telephone, e-mail, etc..), information/promotional messages/referring to the commercial activities of Golden Wine.
